SU-295 – Pre-Award and Post-Award Debriefings
Is the government obligated to provide a debriefing on its decisions to unsuccessful bidders or offerors? Well, the short answer is - it depends. There is an abundance of confusion as to whether the government is compelled to inform competitors of the rationale behind selection of one firm over another.
This course will address the regulatory requirements and specific circumstances when the government is obligated to advise competitors of their selection decision, when they are under no obligation to do so, and when the government’s decision to debrief a firm is discretionary. The course will also address the timing and the types of information the government is obligated to disclose together with the Federal Acquisition Regulation (FAR) provisions and guidance contracting workforce personnel must adhere to in making decisions regarding debriefing requirements.
